Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Calerio mobile app and this website (together, the "Service"), operated by Calerio ("Calerio," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Calerio. If you are under the age of majority in your jurisdiction, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at contact@calerio.info if you suspect unauthorized use.

3. Description of Service

Calerio helps you log meals and track calories and macronutrients using photo, barcode, and voice input, and can sync with Apple Health. Calorie and macro estimates are generated automatically and are approximations — actual nutritional content of food can vary.

4. Not Medical Advice

Calerio is a general wellness tool and does not provide medical advice, diagnosis, or treatment. Estimates, targets, and insights shown in the app are not a substitute for advice from a qualified physician, registered dietitian, or other healthcare provider. Consult a healthcare professional before making significant changes to your diet, especially if you have a medical condition, are pregnant or nursing, or have a history of disordered eating.

5. Subscriptions and Payments

• Certain features require a paid subscription. Prices are shown in the app before purchase and are billed through the Apple App Store or Google Play.
• Subscriptions automatically renew for the same term unless canceled at least 24 hours before the end of the current period. Manage or cancel your subscription through your Apple ID or Google Play account settings — we cannot process cancellations or refunds directly.
• Refunds are governed by Apple's and Google's respective refund policies.
• We use RevenueCat to manage subscription entitlements across devices and platforms.

6. User Content

"User Content" means photos, voice recordings, meal descriptions, and other content you submit to Calerio. You retain ownership of your User Content. You grant us a limited license to process, store, and use it solely to provide and improve the Service. You are responsible for ensuring you have the right to submit any User Content, and for its accuracy.

7. Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service; upload content that is unlawful, abusive, or infringes another's rights; or use automated means to scrape or extract data from the Service without our written permission.

8. Intellectual Property

The Service, including its design, software, trademarks, and content (excluding User Content), is owned by Calerio or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

9. Third-Party Services

The Service relies on third-party providers, including Apple HealthKit, Supabase, RevenueCat, and Mixpanel, to operate. We are not responsible for the availability or performance of these third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CALORIE OR MACRO ESTIMATES ARE ACCURATE OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALERIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH-RELATED OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with notice where reasonably possible.

13. Changes to the Service or Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you may have under the laws of your country of residence.
